When an adult family member is no longer able to properly care for their own health or property, it can make things very difficult for all parties involved. In situations like this, a court has the authority to to create a Conservatorship. A Conservatorship is created by a court order and grants a trustworthy individual or family member the authority to lawfully make all decisions regarding the ill family members property, person, or both.
First, a petition seeking Conservatorship must be filed with the appropriate court. Next, the court will appoint a Guardian Ad Litem to investigate all related matters and determine whether the proposed Conservatorship is appropriate and necessary. Then the Guardian Ad Litem will file a required report with the court and a hearing will take place. The court generally gives great deference to the Guardian Ad Litem’s report.
If the court finds that a Conservator is necessary for a challenged individual, their property, or both, and that the person seeking to be the Conservator is reliable and serving the best interests of the ill family member, the court may order the Conservatorship.
